(...)  L’oeuvre d’art, qu’elle travaille les mots, les sons ou les images, est toujours de l’ordre de la représentation. Elle impose donc par nature une distanciation qui permet de l’accueillir sans la confondre avec la réalité. C’est pourquoi l’Artiste est libre de déranger, de provoquer, voire de faire scandale. Et c’est pourquoi son oeuvre jouit d’un statut exceptionnel, et ne saurait, sur le plan juridique, faire l’objet du même traitement que le discours qui argumente, qu’il soit scientifique, politique ou journalistique…

Cela ne signifie pas que l’Artiste n’est pas responsable. Il doit pouvoir rendre compte au public, mais toujours dans le cadre de la critique de ses oeuvres, et certainement pas devant la police ou les tribunaux.

Il est essentiel pour une démocratie de protéger la liberté de l’artiste contre l’arbitraire de tous les pouvoirs, publics ou privés. Une oeuvre est toujours susceptible d’interprétations diverses, et nul ne peut, au nom d’une seule, prétendre intervenir sur le contenu de l’oeuvre, en demander la modification, ou l’interdire.

L’histoire a toujours jugé avec sévérité ces censures et ces condamnations qui furent, au fil des temps, l’expression d’un arbitraire lié à une conception momentanée de l’ordre public, de l’ordre moral, voire de l’ordre esthétique.

Nous affirmons que le libre accès aux oeuvres est un droit fondamental à la fois pour l’artiste et pour le public. (...)

MANIFESTO of the OBSERVATORY for the FREEDOM of CREATION

(...) The work of art, using whatever words, sounds, or images, is always in the field of representation. By nature It is necessary to take distance with it, which allows to welcome it whithout mixing it with reality. That is why the Artist is free to disturb, free to provoke, even to cause a scandal. And that is why his work does receive an exceptional status, and in legal terms, should under no circumstances receive the same treatment as a argumentative speech, even a scientific, a political, or a journalistic one....
It doesn't mean the Artist is not responsible. He must be able to report to the public, but always within the criticism of his work, and certainly not before the courts or the police.
It is essential for a democracy to protect the artistic freedom from arbitrary of all the powers, public authority, or private. An artwork is always subject to various interpretations, and no one may seek to interfere on the contents of a work, request their modification, or impose prior restraint on behalf of anybody.
History always judged with severity this censorship and this condemnation, which were over time the expression of arbitrary of a momentary conception of public policy, of a moral order, or aesthetic improvement.
We affirm that the free access to the artworks is a fundamental right, for the artist as for the public. (...)
